18-wheeler caused $4k worth of damage, woman claims

A Madison County woman claims she incurred vehicular damage of about $4,000 after she was struck by an 18-wheeler.

Diane Joyce filed a lawsuit Sept. 10 in St. Clair County Circuit Court against Garrett Alan Doby and Willie Jean Logistics.

Joyce claims she was driving north on Illinois Route 50 in O'Fallon on Sept. 29, 2008, at about 11:30 a.m. when Doby, who was driving a 2000 Freightliner in the same direction for Willie Jean Logistics, attempted to make a right turn from the left-hand lane. At the same time, Joyce was in the right lane and trying to make a right-hand turn. As a result, Doby collided with Joyce, according to the complaint.

Later, Doby admitted he was at fault, the suit states.

Joyce was made sick, sore, lame, disordered and disabled, suffered severe pain and anguish in body and mind and incurred medical costs, all of which cost her more than $50,000 in damages, the complaint says.

Joyce blames Doby for failing to keep the vehicle under proper control, for failing to keep a proper lookout, for failing to exercise awareness of his surroundings and for failing to make proper use of the instrumentalities under his control.

In the two-count suit, Joyce is seeking a judgment of more than $100,000, plus costs.
