Collinsville rear-end accident is subject of suit

A woman is seeking more than $50,000 from the driver who she says rear-ended her.

Bobbie J. Demoro Whitehead filed a lawsuit Aug. 27 in Madison County Circuit Court against Edgar J. Walker.

Whitehead claims she was driving north on Route 159 at its intersection with Crestmoor Street in Collinsville on Jan. 7, 2008, at about 9:40 a.m. when Edgar J. Walker, who was driving behind her, rear-ended her.

Because of the collision, Whitehead was made sick, sore, lame, disordered and disabled, suffered extensive injuries to her head, body, limbs, neck and back and incurred medical costs, according to the complaint. In addition, she suffered disability, experienced pain and suffering, lost wages and suffered an impairment of her future earning capacity, the suit states.

Walker negligently failed to keep a proper lookout, drove so as to strike the rear of Whitehead's vehicle, failed to properly apply his brakes, drove too fast, followed Whitehead's vehicle too closely and drove his vehicle without adequate brakes, Whitehead claims.

In addition to the more than $50,000, Whitehead is seeking costs.

John H. Hustava of Collinsville will be representing Whitehead.

Madison County Circuit Court case number: 09-L-892.
