Sauget accident is subject of suit

A man has filed suit against the driver who he says collided with him after failing to yield right-of-way.

Demarcus Mitchell claims he was driving south on Goose Lake Road at its intersection with Grizzlie Bear Boulevard in Sauget on Aug. 22 at about 10:05 p.m. when the incident occurred.

"At the aforementioned time and place, the defendant, Charles W. Sparks, failed to yield the right of way to the plaintiff's motor vehicle, causing a collision to occur and injury to the plaintiff, Demarcus Mitchell," the suit states.

Because of the collision, Mitchell was made sick, sore, lame, disordered and disabled, suffered extensive injuries to his head, body, shoulders, neck, back and left hand and incurred medical expenses, according to the complaint. He also suffered disability, experienced pain and suffering, lost wages and suffered an impaired earning capacity, the complaint says.

Sparks negligently failed to keep a proper lookout for other vehicles on the road, failed to properly apply his brakes, drove too fast, failed to yield the right-of-way and drove without adequate brakes, Mitchell alleges.

Mitchell is seeking a judgment of more than $50,000, plus costs.

He is represented by John H. Hastava of Collinsville.
