Promissory note unpaid, lawsuit claims

The holder of a promissory note claim the entity that owes money under the terms of the note has failed to make monthly payments.

Nitin K. Doshi filed a lawsuit July 28 in St. Clair County Circuit Court against 190 Orange Avenue.

Doshi claims its predecessor in interest, Eagle Hospitality, entered into a promissory note to sell 190 Orange Avenue real estate at 1234 Centreville Ave. in Belleville.

Later, 190 Orange Avenue assigned the note to Doshi, according to the complaint.

However, 190 Orange Avenue has failed to make all of its monthly payments, even though Doshi has demanded payment on numerous occasions, the suit states.

"That after allowing all just credits and refunds, the Defendant is indebted to Plaintiff in the amount of $64,350, plus interest, plus attorney fees and costs," the complaint says.

In addition to the amount it says it is owed, Doshi is seeking interest at 8 percent per annum from Feb. 11, attorney's fees and costs.
