A New Athens woman is alleging she was injured after the driver of the car in which she was riding lost control and caused the vehicle to roll down an embankment.
Briana Clark filed a suit July 28 in St. Clair County Circuit Court against Jenna Fox.
Clark claim she was riding in a car Fox was driving northeast on Waterloo Road in Millstadt on Aug. 8, 2007.
"That at said time and place, the defendant, Jenna Fox lost control of her vehicle, which rolled down into an embankment before coming to a rest," the suit states.
Because of the accident, Clark was made sick, sore, lame, disordered and disabled, suffered a fracture to her back and received injuries to her shoulder and neck, according to the complaint. In addition, Clark incurred medical costs and experienced pain and suffering, the complaint says.
Clark blames Fox for failing to apply her brakes, for failing to keep her vehicle under control and for driving too fast.
Clark is seeking a judgment of more than $50,000, plus costs.
