R P Lumber sues to recover unpaid bill

A lumber company has filed suit against a construction company, alleging it did not pay for lumber materials supplied.

R.P. Lumber Co. Inc. says it provided John Wesselman, doing business as Midwest Construction, with building supplies and materials on June 6, 2007, through April 13.

The building supplies and materials were charged to Wesselman's credit account with R.P. Lumber Co., according to the complaint filed June 19 in Madison County Circuit Court.

However, Wesselman has failed to pay for all the materials he purchased, the complaint says.

"After allowing for all payments and credits there is still due and owing the Plaintiff from the Defendant the sum of $75,396.86, which includes interest," the suit states.

In addition to the amount it says it is due, R.P. Lumber Co. is seeking interest, attorney's fees, costs and other relief the court deems just.

It is represented by Ronald D. Lowery of Edwardsville.

Madison County Circuit Court case number: 09-L-650.
