The passenger of a car has filed a lawsuit against the driver who he says ran a stop sign and hit the vehicle in which he was riding, saying he was seriously injured as a result.
Orisa J. Babcock says he was riding in a 1998 Chevrolet Tahoe Lynn A. Robertson was driving north on Westerholdt on June 21, 2007.
At the same time, Thomas V. Guccione was driving a 2002 Chevrolet Silverado and disregarded a stop sign at the intersection of Westerholdt and Rosewood, colliding with Robertson, according to the complaint filed June 10 in Madison County Circuit Court.
Because of the collision, Babcock suffered pain and lost wages, the suit states.
Guccione failed to keep his vehicle under control, failed to stop or slow down to avoid a collision and failed to keep a proper lookout, the complaint says.
Babcock is seeking a judgment of more than $50,000, plus costs.
He will be represented by Edward W. Unsell of East Alton.
