I-70 collision caused injuries, man claims in suit

A man says he received serious injuries after the car in which he was a passenger collided with another vehicle in Madison County.

Charles L. Roberts filed a lawsuit June 8 in Madison County Circuit Court against Scott Gregory Oakes and Edna Ruth Roberts.

Charles Roberts says he was riding in a Chrysler that Edna Roberts was driving west on I-70 July 20, 2007, at about 2:54 p.m.

While the pair was traveling, Scott Gregory Oakes attempted to merge his Ford into the lane of traffic in which the Roberts were driving. That caused Edna Roberts to lose control of her vehicle and to crash into another vehicle being driven by Mark Cipola, according to the complaint.

Because of the accident, Charles L. Roberts incurred medical expenses and experienced pain, suffering, loss of enjoyment of a normal life, disability, disfigurement and lost earning capacity, the suit states.

Oakes failed to drive within his lane of traffic, failed to keep his vehicle under control and failed to keep a proper lookout, the complaint says.

Edna Roberts failed to maintain control of her vehicle.

In the two-count suit, Charles L. Roberts is seeking unspecified damages.

David R. McGinley of Kupets and DeCaro in Chicago will be representing him.
