Smithton accident caused injuries, woman claims

A woman has filed suit against the person who she says caused her severe and permanent injuries after striking her vehicle.

Mallory Melvin claims she was driving southwest on Schluete Germaine Road in Smithton on Feb. 26 when Samantha Kaitlyn Ball, who was driving northeast on the same road, crossed into her lane of traffic and collided with her vehicle.

Because of the collision, Melvin sustained severe and permanently disabling injuries to her shoulders, neck and knees, plus suffered pain and mental anguish, according to the complaint filed June 10 in St. Clair County Circuit Court. In addition, Melvin lost large sums of money because of her inability to pursue a normal occupation and incurred substantial medical costs, the complaint says.

Ball negligently failed to keep a proper lookout, failed to keep her vehicle under control, failed to keep her vehicle in the proper lane and drove too fast for the road conditions.

Melvin is seeking a judgment in excess of $50,000, plus costs.

She will be represented by Bruce R. Cook.

St. Clair County Circuit Court case number: 09-L-305.
