Amended complaint filed in Campbell's suit against Weiss over class fees

A breach of contract suit between Godfrey attorney Timothy Campbell and his former co-counsel Paul Weiss of Chicago continues.

Campbell is suing Weiss and his firm Freed & Weiss LLC, for two counts of breach of contract in the amended complaint filed last month. That is down from two counts of breach of contract and two counts of conversion in his original complaint filed April 30, 2008.

Campbell's amended complaint alleges that Paul Weiss has refused to turn over parts of settlements the two won on behalf of chiropractor Frank Bemis and Winnie R. Madison. Campbell and Weiss both worked on the case. Campbell argues that Weiss agreed to share the fees recovered from the lawsuits.

In both complaints Campbell has sought damages in excess of $50,000 and costs.

Campbell contends e-mails confirm an agreement between the lawyers to work on the cases together. Campbell argues in the complaints that he fulfilled all of his obligations to the clients and is owed the fees as a result.

The amended complaint drops Campbell's allegations that Paul Weiss and the firm converted funds he was owed.

The case is Madison case number 08-L-364.
