A man is suing his brother, saying he fell from a ladder as he was helping his brother remove a tree limb from his property.
Shaun Milleson filed a lawsuit June 3 in St. Clair County Circuit Court against Arben Milleson.
Shaun Milleson says he was helping his brother on Sept. 1 remove a tree limb from his brother's property at 402 Hartman Lane in O'Fallon.
As Shaun Milleson was working on a ladder, he fell after a tree branch struck him and was severely injured, according to the complaint.
Because of his injuries, Shaun Milleson says he incurred medical costs and lost wages from work.
Arben Milleson was negligent by providing his brother with an unstable ladder, by allowing a tree branch to strike his brother, by not providing a safe place for Shaun Milleson to stand while removing the limb and by providing his brother with a defective ladder.
Shaun Milleson is seeking a judgment in excess of $50,000.
John M. English of Kassly, Bone, English and Hillebrand in Belleville will be representing him.
St. Clair County Circuit Court case number: 09-L-290.
