Woman claims hand injuries have caused great damage to psyche

A Missouri woman has filed suit against Green Roof Blocks and its property owners, alleging she seriously injured her right hand while attempting to open a gate.

Cynthia M. Kalkbrenner claims she was visiting Green Roof Blocks, located on the 3500 block of State Route 162 in Granite City, on May 31, 2007, when she attempted to open a gate.

Although the lawsuit filed May 29 does not specify how Kalkbrenner injured her hand while opening the gate, it does say the gate was in a dangerous condition.

Because of the gate, Kalkbrenner says the injuries to her hand will cause damage to her psyche and will cause great pain, suffering, disability and loss of a normal life. Kalkbrenner also incurred medical costs and suffered a loss of earnings, the complaint says.

In addition to Green Roof Blocks, property owners Kelly W. Luckett, Patricia J. Luckett, Michael Crowell and Judy T. Crowell are named as defendants.

The property owners were negligent by failing to warn Kalkbrenner of the dangerous condition, by failing to maintain the property in a safe condition, by allowing the gate to remain in an unsafe condition, by failing to perform regular inspections of the property, by failing to properly fix the gate and by failing to block the entrance to the gate, the suit states.

In the five-count suit, Kalkbrenner is seeking a judgment of more than $250,000, plus costs and other relief the court deems just.

She is represented by Peter S. Blast of Roth Evans in Granite City.
