Jennifer Burns has filed suit against William H. DeCarr, claiming her vehicle sustained significant damages and she was injured after DeCarr collided with her.
Burns claims she was driving east on Central Park near its intersection with Hartman Lane in O'Fallon on June 15, 2007.
At the same time, DeCarr was driving west on Central Park near the same intersection when he failed to yield the right-of-way and collided with Burns, according to the complaint filed May 21 in St. Clair County Circuit Court.
In addition to the damages to her vehicle, Burns says she experienced injuries to her head, face, body and limbs and suffered bodily pain. She also incurred medical costs, will be unable to attend to her usual occupation and lost large sums of money she would have earned, the suit states.
DeCarr negligent failed to keep a proper lookout, drove too fast for the traffic, drove so as to collide with Burns, failed to keep his vehicle under control, failed to yield the right-of-way, failed to equip his vehicle with adequate brakes, failed to maintain the brakes and failed to slow down or stop to avoid striking Burns, the complaint says.
Burns is seeking a judgment in excess of $50,000, plus costs.
Carmen S. Durso of Belleville will be representing her.
