An Alton Steel corporation is suing a Chicago metal company over its alleged failure to pay for more than $120,000 worth of steel delivered to it.
Alton Steel filed a lawsuit May 5 in Madison County Circuit Court against iMetals.
Alton Steel says iMetals entered into purchase orders with Alton Steel for steel bar products. In the orders, iMetals agreed to pay in full for the merchandise within 30 days after receiving it, the complaint says.
However, after receiving the shipment and even after receiving an invoice, iMetals has failed to pay the $120,484.50 Alton Steel says it is due.
"As a result of Alton Steel having supplied said steel bar products to iMetals and iMetals's failure to pay for the same, iMetals has been unjustly enriched," the suit states.
In addition to the balance it is due, Alton Steel is seeking interest, attorneys' fees, costs and other relief the court deems just.
