A woman has filed suit against Supervalu, doing business as Shop N' Save, and Brehan Properties, alleging she fell in a hole in the store's parking lot.
Carla McClennon claims she was walking into the store located at 1721 Homer M. Adams Parkway in Alton on May 20, 2007, when she tripped and fell in a hole in the pavement.
Because of the fall, McClennon was severely and permanently injured, experienced pain and suffering and lost wages, according to the complaint filed May 6 in Madison County Circuit Court. She also incurred medical expenses and was prevented from attending to her usual activities, the suit states.
Supervalu was negligent by failing to keep its pavement and sidewalks in a passable state, by failing to adequately patch defects in its sidewalk or parking lot, by failing to keep a proper lookout for patches or holes in its sidewalk and parking lot and by failing to warn others of the defects, McClennon alleges.
Brehan Properties is liable because it owns Supervalu, according to the complaint.
In the two-count suit, McClennon is seeking a judgment of more than $100,000, but less than $150,000.
