Ernest J. Williams, Tameaka C. Helm and James R. Green have filed a lawsuit against David W. Price and B. Garcia Trucking Company, alleging they were injured after Price collided with them while driving on the highway.
Williams was driving a 2002 Dodge Intrepid in the left-hand lane of Mississippi Avenue in East St. Louis on Dec. 22 while Price was driving a vehicle owned by B. Garcia Trucking Company in the center lane of Mississippi Avenue, according to the complaint filed May 6 in St. Clair County Circuit Court.
Suddenly, Price struck the vehicle Williams was driving, the suit states.
At the time of the accident, Helm and Green were passengers in Williams's vehicle.
Because of the accident, Williams, Helm and Green claim they sustained serious and disabling injuries, incurred medical costs, experienced pain, suffering and emotional distress and were unable to carry out their usual activities. They also lost money and sustained disability and disfigurement, according to the complaint.
In addition, Williams could not use his Dodge because of damages to it and incurred costs when he was required to rent a vehicle.
Price was negligent by driving too fast, by failing to reduce his speed to avoid a collision, by failing to keep a sufficient look-out for traffic and by failing to drive within a single lane, the suit states.
In the eight-count suit, the plaintiffs are seeking a judgment in excess of $300,000 and damages for the rental car of less than $10,000, plus costs.
