ESL police pension trustees sue man who cashed deceased father's checks

Trustees of the East St. Louis Police Pension Fund have filed suit against Claven Harvey Jr., alleging he continued to cash his father's pension checks from the East St. Louis Pension Fund even after his father's death.

The East St. Louis Pension Fund made monthly retirement pension payments to Claven Harvey Sr. from his retirement on July 29, 1989, until September 2007, according to the complaint filed Feb. 24 in St. Clair County Circuit Court.

However, Claven Harvey Sr. died on Sept. 25, 2003, the suit states.

After Claven Harvey Sr.'s death, Claven Harvey Jr. cashed the $76,708.79 worth of checks his father continued to receive, the trustees claim.

The trustees sent a letter to Claven Harvey Jr. demanding a refund of the money after they discovered what happened, but he has failed to respond, according to the complaint.

The trustees are seeking a judgment in excess of $50,000, plus pre-judgment interest, costs, attorney's fees and other relief the court deems just.

They are represented by Dennis J. Orsey of Granite City.
