Bauer v. Bauer: Suit filed over auto injuries

Lossie J. Bauer has filed suit against Keith Bauer, alleging she was injured after he failed to put his vehicle in park and caused it to roll down a hill.

Lossie Bauer was riding with Keith Bauer on March 3, 2007, when he stopped in front of a house on Briar Cliff and failed to put the vehicle in park as he exited it, according to the complaint filed Feb. 9 in Madison County Circuit Court.

Keith Bauer resides at 22 Briar Cliff in Collinsville, according to the suit. The complaint does not indicate if the plaintiff and defendant are related.

The suit states that Lossie Bauer was stuck inside the vehicle as it rolled downhill and caused an accident.

Because of the accident, Lossie Bauer claims she suffered permanent and ongoing pain and suffering, a fractured ankle, knee and foot and a bruised chest resulting in chronic obstructive pulmonary disease.

She also incurred surgical expenses, according to the complaint.

Keith Bauer breached his duty of due care to Lossie J. Bauer by failing to properly put the vehicle in park and by failing to control his vehicle to avoid an accident, the suit states.

Lossie Bauer is seeking a judgment in excess of $50,000, plus other relief the court deems just.
