Cell phone blamed for woman's 'traumatic' injuries in car accident

A Madison County woman claims a Macoupin County man's cell phone use was partly to blame for a collision that left her scarred and injured.

Kendyl M. Schmidt was driving east on Governor's Parkway on Feb. 12, 2007, and beginning to turn right on Plum Street in Madison County when David P. Pryor, who was driving south on Plum Street, collided with the side of her vehicle, according to the complaint filed Feb. 6 in Madison County Circuit Court.

Because of the accident, Schmidt sustained "traumatic injuries" to her head, face and left leg and incurred scarring and disability, the suit states.

She also claims she suffered lost wages, incurred medical expenses and endured pain and suffering.

Pryor was negligent by failing to maintain a constant lookout, by failing to keep his vehicle under control, by driving too fast for the conditions and by talking on a cell phone, according to the complaint.

Schmidt is seeking a judgment in excess of $50,000, plus costs.
