Injuries claimed in rear-end accident

Cynthia Whorl has filed suit against Marvin Jackson, alleging she and her recently deceased husband, Gerald Whorl, were injured after Jackson rear-ended them.

Cynthia Whorl was driving on Broadway Connector and preparing to turn right onto East Broadway on Feb. 9, 2007, when Jackson, who was behind her, struck the rear bumper of her vehicle, according to the complaint filed Feb. 5 in Madison County Circuit Court.

Gerald Whorl was riding as a passenger in the same vehicle as Cynthia Whorl at the time of the accident, the suit states.

Because of the collision, Cynthia Whorl claims she and Gerald Whorl were made sick, sore, lame and disordered, suffered a loss of earning capacity and experienced pain and suffering.

They also incurred substantial medical costs, suffered disability and disfigurement and sustained property damages, according to the complaint.

Jackson was negligent by failing to keep a proper lookout, by failing to brake and by failing to keep his vehicle under control.

In the two-count suit, Cynthia Whorl is seeking a judgment in excess of $100,000, plus costs and other relief the court deems just and proper.

They are represented by Lon D. Weaver of Weaver Law Office in Bethalto.

Madison County Circuit Court case number: 09-L-0101.
