William Morgan has filed suit against John F. Miller, alleging he was injured after Miller struck him while making a U-turn.
Morgan was driving his 1994 Mazda Protege on Feb. 16, 2007, at about 9:13 a.m. when Miller, who was driving a 2000 Dodge Ram pickup truck, attempted to make a U-turn from a parked position, according to the complaint filed Jan. 30 in Madison County Circuit Court.
But instead of successfully completing the U-turn, Miller hit Morgan, the suit states.
Because of the accident, Morgan claims he suffered injuries, pain of the body and mind, incurred medical costs and lost sums of money.
Miller was negligent by failing to keep a proper lookout for vehicles, by failing to keep his vehicle under proper control, by failing to brake his vehicle in time to avoid striking Morgan and by failing to steer his vehicle to avoid striking Morgan, according to the complaint.
Miller also negligently failed to yield the right-of-way, the suit states.
Morgan is seeking a judgment of $50,000, plus costs.
