Moto Mart customer claims injuries from slipping on water

A woman has filed suit against a St. Clair County store, alleging her right knee was injured after she fell while shopping in the establishment.

Mary Hershberger was walking in Moto Mart on the aisle between the checkout counter and the first aisle when she slipped on water and fell July 29, according to the complaint filed Nov. 12 in St. Clair County Circuit Court.

In addition to her injured knee, Hershberger incurred medical expenses, sustained great pain and mental anguish and incurred disability and loss of a normal life, the suit states.

She claims she has also lost numerous working days and opportunities.

Moto Mart breached its duty to keep its store in a safe condition because its employees attempted to mop the floor and left accumulated water in a dangerous area, failed to post adequate warnings about the water and failed to properly clean up the water in the aisle, according to the complaint.

The store's employees also negligently failed to provide a safe entrance and exist for patrons and mopped up the floor but left the floor wet, the suit states.

Hershberger is seeking a judgment in excess of $50,000.
