Mother sues driver over injuries suffered by children

A Madison woman has filed suit individually and on behalf of her two children against a man, alleging all three suffered fractures and sprains after a collision.

LaShawnda McGill and her two children, Hasani and Justin, were passengers in a vehicle traveling south on North 25th Street at its intersection with Ohio in St. Clair County on Nov. 10, according to the suit filed Nov. 10 in St. Clair County Circuit Court.

Kenneth McCaskill was traveling north on North 25th Street when he "moved his vehicle across the center lane and ultimately struck the vehicle in which Plaintiff was a passenger," the suit states.

Because of the collision, LaShawnda claims she, Hasani and Justin endured several diagnostic tests and various pain management and physical therapies and sustained permanent, partial and total disabilities to their bodies.

In addition, the three sustained non-economic damages, including pain and suffering, mental anguish, inconvenience, physical impairment and the loss of capacity to enjoy life, according to the complaint.

They also sustained and will continue to sustain economic damages, including medical costs, the suit states.

"All of Plaintiff's physical and emotional injuries have been painful, and will continue to be painful in the future, and my be associated with causing, accelerating and aggravating, triggering or otherwise bringing about additional injuries, all of which may be painful and continue to be painful and disabling, both physically and emotionally," the suit states.

LaShawnda claims McCaskill was negligent because he drove across the center line, failed to keep his vehicle under control, failed to warn of his approach and failed to keep and maintain a constant lookout.

In the three-count suit, LaShawnda is seeking $150,000, plus costs and other relief the court deems just.
