Fairview Heights accident victim alleges injuries

Amy Harris has filed suit against Brett Smithee, alleging her neck, back and shoulder were injured after he rear-ended her.

Harris was driving south on Illinois 159 at its intersection with Market Place in Fairview Heights on Oct. 19 when the incident occurred, according to a complaint filed Nov. 10 in St. Clair County Circuit Court.

In addition to her injuries, Harries was made sick, sore, lame, disordered and disabled and incurred substantial medical costs, the suit states.

Harris claims she also suffered disability, experienced pain and suffering and lost wages.

Smithee was negligent because he failed to keep a proper lookout, drove into the rear of Harris's vehicle, failed to properly brake, drove too fast and drove too closely to the back of Harris's car, according to the complaint.

Harris is seeking a judgment in excess of $50,000, plus costs.

She will be represented by Thomas C. Rich and Jennifer L. Barbieri of Fairview Heights.
