Suit claims landscaper responsible for car accident

Lloyd Voyles has filed suit against Steven Kislowski and Cobblestone Landscaping, alleging his neck, shoulder and low back were injured after a rear-end collision.

Voyles was driving east on Route 161 at its intersection with Josephine Drive in Swansea on Jan. 12, 2007, at 12:32 p.m. when Kislowski crashed into the rear of his vehicle, according to a complaint filed Nov. 6 in St. Clair County Circuit Court.

Kislowski was working for Cobblestone Landscaping at the time of the accident, the suit states.

In addition to his injuries, Voyles was made sick, sore, lame disordered and disabled, incurred substantial medical costs and suffered disability, the suit states.

Because of his injuries, Voyles claims he experienced pain and suffering, lost money and suffered an impairment of his future earning capacity.

Kislowski was negligent because he failed to keep a proper lookout, drove into the rear of Voyles's car, failed to properly brake, drove too fast, followed Voyles too closely and drove his car on the highway without adequate brakes, according to the complaint.

Because Kislowski was working for Cobblestone Landscaping, it is liable for the accident, the suit states.

In the two-count suit, Voyles is seeking sums in excess of $100,000, plus costs.

He will be represented by John H. Hustava of Collinsville.
