Driver's heart attack blamed for woman's injuries

A Belleville woman has filed suit against the estate of a deceased Cahokia man, claiming her leg, ankle, hands and wrist were injured after the man, who had a heart attack while driving, collided with her.

Lindsey Swearingen was driving west on 74th Street at the intersection of Route 13 in Belleville on April 11 when George Robbins III suffered the heart attack and collided with her, according to the complaint filed Nov. 7 in St. Clair County Circuit Court.

In addition to her injuries, Swearingen spent money on medical costs, suffered disability because of her injuries, experienced pain and suffering and lost wages, the suit states.

Swearingen claims Robbins was negligent because he failed to keep a proper lookout, drove in such a way that caused a collision, failed to keep his vehicle under control and failed to properly apply his brakes.

She is seeking a judgment in excess of $50,000, plus costs.

James R. Williams of Williams, Caponi, Foley and Eckert in Belleville will be representing her.

St. Clair County Circuit Court case number: 08-L-573.
