A slip and fall case has been filed against Shop 'N Save in Madison County Circuit Court.
Sherrell P. Gibson of Collinsville claims she was shopping at the grocery store, located at 717 Vandalia Road in Collinsville on June 22, 2007, when she slipped and fell on a wet substance that accumulated on the floor.
Gibson claims Shop 'N Save was under a legal duty to own, operate, maintain, manage and/or control the facility in a reasonably careful manner so as not to cause injury to persons who were lawfully on its premises.
Gibson claims the grocery store breached its duty when it negligently created the accumulation of the wet substance in a place it knew or should have known that patrons would walk while shopping.
She also claims Shop 'N Save negligently failed to inspect and clean the area where the water had accumulated, failed to warn patrons of the hazard by putting up cones or signs warning of the wet substance and failed to supervise any outside companies that were retained to clean their facility.
Gibson claims the fall made her sick, sore, lame and disordered and also caused extensive injuries to her neck, back, left shoulder and left hip.
According to Gibson, her injuries caused and continue to cause her to experience pain and suffering, medical expenses, loss of earning capacity, lost wages and sustained a disability and disfigurement.
Gibson is seeking damages in excess of $30,000.
She is represented by Roy Dripps of the Lakin Law Firm in Wood River.
The case is awaiting mandatory arbitration.
