Hip fracture results in suit against Saint Anthony's

Joyce Schmidt has filed a suit on behalf of Gertrude I. Luebbert against Saint Anthony's Health Center, alleging Luebbert fractured her hip after she fell in the hospital.

Luebbert was admitted to Saint Anthony's Nov. 3 for monitoring after she had a seizure, according to the complaint filed Sept. 23 in Madison County Circuit Court.

Luebbert fell while in her hospital room on Nov. 4 and sustained a nondisplaced intertrochanteric fracture of her right hip, the suit states.

Schmidt claims Luebbert suffered acute and prolonged physical and mental pain and suffering and had to pay medical costs as a result of the fall.

She claims Saint Anthony's was responsible with providing staff that would render appropriate patient care.

The hospital was negligent because its staff failed to review the fall risk assessment questionnaire and to implement adequate measures to protect Luebbert from a fall, according to the complaint.

Schmidt is seeking a judgment in excess of $50,000, plus costs of the suit.
