Alton collision leads to suit

James A. Berry has filed suit against Terry Gansz, alleging he was injured after a collision.

Berry was driving near the intersection of Olin Corporation, his place of employment, and a parking lot on Sept. 19, 2006, in Alton, according to a complaint filed Sept. 18.

Gansz had just finished work and was pulling out of the parking lot when he collided with Berry, the suit states.

Berry claims that as a result of the accident, he was made sick, sore, lame and disordered and that he suffered extensive injuries.

He also claims he has suffered a loss of earning capacity and has experienced pain, suffering, disability and disfigurement.

Berry has become responsible for substantial medical costs, according to the complaint.

Gansz was negligent because he failed to keep a proper lookout, failed to brake, failed to keep his vehicle under proper control and failed to yield to oncoming traffic, the suit states.

Berry is seeking a judgment in excess of $50,000, plus costs of the suit.
