Bonneville-Ranger accident subject of suit

Martha Hebert has filed suit against Thomas P. Russell, III, alleging she was injured after an accident in which he was at fault.

Hebert was driving her 1998 Pontiac Bonneville west in an alley from Troy Road near its intersection with another alley from First Avenue in Edwardsville on Oct. 24, 2006, according to a complaint filed Sept. 18.

Russell was driving his 1999 Ford Ranger north on the alley from First Avenue when he entered the alley Herbert was driving in and collided with her vehicle, the suit states.

Herbert claims she was injured and has suffered pain of body and mind.

She also claims she has become responsible for medical costs and has lost money.

Russell was negligent because he failed to keep his truck under control, failed to brake in time to avoid hitting Hebert, failed to steer his vehicle to avoid hitting Hebert and attempted to enter an intersection when it was unsafe to do so, according to the complaint.

Hebert is seeking a judgment in excess of $50,000, plus costs.
