Scott Marshall has filed suit against Ace's Neighborhood Inn, alleging he lost his ear after a fight the inn could have prevented.
Marshall was at Ace's Neighborhood Inn March 27 when he was attacked by a fellow patron, Steven A. Marckovic, according to the complaint filed Sept. 15 in St. Clair Circuit Court.
At the time of the fight, Marckovic was intoxicated through liquor sold him by the inn, the suit states.
"The intoxication of Steven A. Marckovic caused or contributed to cause the injuries sustained by Plaintiff Scott Marshall," the suit states.
Marshall claims he has spent $30,000 on medical bills and has suffered the loss of an ear.
He also claims he has suffered a loss of wages.
Ace's Neighborhood Inn was negligent because it knew of Marckovic's propensity for violence and should have warned Marshall, failed to protect its customers and failed to intervene in the assault, the suit states.
In the two-count suit, Marshall is seeking a judgment in excess of $100,000, plus costs.
