Plaintiff in car wreck suit claims she underwent two surgeries

Dawn M. York has filed suit against Amy L. Shoemaker and Julie M. Featsam, alleging she had to undergo at least two surgeries after a collision.

York claims that on Dec. 24, 2006, at about 12:04 p.m., Fietsam was driving north on Illinois Route 161 with York as her passenger, according to a suit filed Sept. 12 in St. Clair County.

The car collided with another vehicle driven by Shoemaker, who was heading east on East B Street, the suit states.

York claims she was made sick, sore, lame, and disordered and suffered extensive injuries to her head, body, limbs and the soft tissues of the cervical, thoracic and lumbar spine.

In addition, she claims she suffered contusions to her face, scalp, neck and right knee, plus ongoing headaches dizziness and hair loss, rotator cuff strain, ankylosis of the right shoulder region requiring arthroscopy surgery and a bone chip in the right foot requiring ostectomy-calcaneus surgery.

As a result of the injuries, York has suffered disability and disfigurement and pain and suffering, plus has incurred medical costs, the suit states.

Shoemaker was negligent because she collided with another vehicle, failed to keep a proper lookout, drove too fast, failed to decrease her speed in order to avoid the accident, failed to drive in only one lane, failed to yield the right-of-way, failed to operate a vehicle with adequate brakes and failed to obey a traffic control device, according to the complaint.

Fitsam was negligent because she failed to keep a proper lookout, drove too fast, failed to operate a vehicle with adequate brakes and failed to obey a traffic control device, the suit states.

In the two-count suit, York is seeking a judgment in excess of $100,000, plus costs.

Jack Carey in Belleville will be representing her.
