Man sues after gas station fall

Robert Dickerson has filed a personal injury complaint against Murphy Oil USA, alleging the gas station failed to maintain their property in a safe manner.

Dickerson said he was at Murphy on July 15, 2006, when he slipped and fell in a puddle of an oily substance.

"There was no sign warning of the oily grounds and puddle," according to the complaint filed in Madison County Circuit Court on July 11.

Dickerson claims Murphy carelessly and negligently breached its duty of reasonable care in the following respects:

  • failing to warn him and others of the oily grounds and puddle;

  • failing to inspect the grounds to discover the buildup of the oily substance; and

  • failing to repair the oily grounds and puddle.

    As a result of the alleged negligence, Dickerson claims he sustained physical injuries to his legs, hip, back, pelvis and whole body which caused and continues to cause pain and suffering, medical expenses, lost wages, disability and loss of a normal life.

    He is seeking a judgment in an amount greater that $15,000, but less than $50,000.

    Michael Brunton of Collinsville represents Dickerson.

    The case is awaiting mandatory arbitration.
