Dram shop suit filed against Jerzey's

Jerzey's sports bar in O'Fallon has been named in a dram shop lawsuit filed July 9 in St. Clair County Circuit Court, court papers show.

Gerald W. Frierdich is seeking in excess of $50,000 in damages from the bar, owned by C.B. Sports Bar, Inc., for injuries, pain and suffering, permanent disability and loss of a normal life over an auto accident that happened Aug. 19, 2007.

Frierdich alleges the bar served an excessive amount of alcohol to customer Keith Joseph McCoy.

The so-called "dram shop law" refers to to the liability of alcohol vendors and servers after a motor vehicle accident resulting from excessive alcohol consumption.

"The alcoholic beverages consumed by Keith Joseph McCoy caused his intoxication, and as a result of the intoxication on said date...McCoy drove his automobile while intoxicated thus injuring the plaintiff, Gerald W. Frierdich," the complaint states.

Frierdich is represented by B. Jay Dowling of Sterling and Dowling in Fairview Heights.
