Dale K. Tompkin is suing Kraft Foods Global, Inc. and Capri Sun, Inc. for neck and head injuries he suffered at a Granite City loading dock June 15, 2006.
According to a suit filed June 12 in Madison County Circuit Court, Tompkin alleges the defendants were negligent for failing to organize loaded cargo within a sufficient space so as to prevent the tilting and falling of cargo.
Represented by Kevin T. Dawson of Brown & Associates of Belleville, Tompkin is seeking in excess of $50,000 in damages, plus costs of the suit.
He claims Capri Sun failed to warn him of the unusually heavy and dangerous weight of the loaded cargo in a trailer.
His suit claims he has incurred medical expenses, lost wages, pain and suffering and the loss of enjoyment of life.
