Wet substance on Red Apple floor causes customer's injury

A woman who claims she broke her femur at the Red Apple Restaurant in Maryville, filed a personal injury suit in Madison County Circuit Court Jan. 29, alleging a wet substance on the floor caused her injury.

Lise Boss, a St. Clair County resident, claims she was at the restaurant on Aug. 21, 2006, when she slipped on the slippery and wet floor.

Boss claims the Red Apple failed to warn her of the dangerous condition on the restaurant floor when it knew, or should have known, that the floor would become wet and slippery in the ordinary course of their business.

She also claims the restaurant permitted the wet substance to remain on the floor, when its presence should have been discovered and removed and failed to inspect the floor for the existence of wet substances.

According to Boss, her injury caused her to suffer pain, discomfort, and mental anguish, medical expenses, loss of earnings and benefits and has been restricted in her usual activities.

Represented by S. Russell Meyer of Alton, Boss is seeking damages in excess of $50,000, plus costs of the suit.

The case has been assigned to Circuit Judge Andy Matoesian.
