A woman who purchased a prescription from the Jerseyville Walgreen filed suit in Madison County Circuit Court Nov. 28, alleging she was given the wrong dosage.
Diane Vanmeter claims Walgreen negligently and carelessly failed to distribute proper amounts of pharmaceutical products on Nov. 9, 2006.
She also claims Walgreen negligently failed to properly fill a prescription order as set out by her physician, failed to supervise employees filling prescriptions and distributed an amount of product exceeding her prescription.
"Plaintiff was in the exercise of ordinary care and caution for her own safety and was free from any contributory negligence," the complaint states.
Vanmeter claims as a result of the defendant's alleged negligence, she suffered internal and external injuries, pain and suffering, disability, medical expenses and lost wages.
Represented by Lance Mallon and Dawna Hale of Wood River, Vanmeter is seeking damages in excess of $50,000, plus costs of the suit.
The case has been assigned to Circuit Judge Andy Matoesian.
