FELA complaint filed against Norfolk Southern

Randy Miller filed a Federal Employers' Liability Act suit against Norfolk Southern Railway in Madison County Circuit Court Aug. 15, alleging his employer failed to provide him a safe place to work.

According to Miller, he was subjected to repetitive trauma while repairing Norfolk's tracks from 1978 through 2007.

Miller claims Norfolk negligently and carelessly failed to provide safe methods of work, failed to provide sufficient manpower and failed to provide safe tools and equipment.

He claims he has sustained severe and permanent injuries to his neck, back, spine and body all of which cause great pain and mental anguish, lost wages and medical expenses.

Represented by Gregory Tobin of East Alton, Miller is seeking damages in excess of $50,000, plus costs.

The case has been assigned to Circuit Judge Andy Matoesian.
