Breann Fowlkes filed a personal injury suit against her ex-boyfriend alleging he battered her on May 11, 2006, at a local motel.
According to the suit filed July 25 in Madison County Circuit Court, Fowlkes rented a room at Michael's Swiss Inn and while entering the room, her boyfriend at the time, Robert Rogers, punched her in the face.
Fowlkes claims she was knocked unconscious, had lacerations above and below her eye, has nerve damage in her face, a crooked nose, suffers from headaches and nasal congestion on a regular basis that causes great physical pain, mental anguish and loss of a normal life.
"That as a consequence of the Defendant's intentional act of striking the Plaintiff, a female who stands 5'7" and weighs 120 pounds while the Defendant is a male who stands 6'9" and weighs 205 pounds with his fist resulting in serious bodily injuries to the Plaintiff, that required plastic surgery," the complaint states.
Represented by Matthew Marlen of Belleville, Fowlkes is seeking compensatory and punitive damages in excess of $100,000, plus costs.
The case has been assigned to Circuit Judge Nicholas Byron
