Mac's Time Out blamed in dram shop suit

Pamela Burgess filed a dram shop suit against Mac's Time Out in Madison County Circuit Court July 25, claiming she sustained injuries when an intoxicated patron assaulted her.

According to the complaint, the Alton tavern gave or sold intoxicating beverages to Jerrod Anthony and other patrons on Feb. 4.

Burgess claims Mac's failed to operate its premises in a manner as to not cause injury to her and others lawfully on the premises.

She also claims the tavern negligently failed to supervise patrons, failed to provide adequate security and failed to take adequate precautions from a fight breaking out.

According to Burgess, she sustained disfigurement to her face, pain and suffering, disability and medical expenses.

Represented by Lance Mallon and Dawna Hale of Wood River, Burgess is seeking damages in excess of $50,000.

The case has been assigned to Circuit Judge David Hylla.
