Woman sues after falling in hole on man's property

816 and 818 East 6th Street in Alton

Ramona Bass filed a personal injury suit against James Bailey in Madison County Circuit Court July 5, seeking damages in excess of $50,000.

Bass claims on Oct. 2, 2006, Bailey owned property located at 816 and 818 East 6th Street in Alton and provided a yard and sidewalk for use of all lawful people on the property.

She claims his property contained an extremely wide and deep hole causing the ground to be dangerous.

"Defendant was negligent in permitting the yard to be unsafe for walking," the complaint states.

Bass claims she was attempting to walk from her home when she stepped in the hole causing her to fall which allegedly caused permanent, severe and progressive internal and external injuries, pain and suffering, medical expenses, lost wages and loss of a normal life.

"Defendant had actual or constructive notice of the dangerous condition and had ample time to remedy and repair the condition," the complaint states.

Bass is represented by Benjamin Goldenhersh of Belleville.

The case has been assigned to Circuit Judge Barbara Crowder.
