Woman sues after botched medical procedure

Anderson Hospital

A woman who suffered complications after an outpatient procedure filed a medical malpractice suit against Anderson Hospital and Dr. Dennis Hurford in Madison County Circuit Court June 27.

According to the complaint, on June 29, 2005, Hurford performed a hysteroscopy/ D&C on Barbara Diser at Anderson Hospital.

Diser claims Hurford committed the following acts of professional negligence:

  • failed to properly identify the anatomy during surgery prior to cutting;

  • failed to recognize that he had lacerated the distal small intestine;

  • failed to recognize that he lacerated the mesentery;

  • allowed her to be discharged after lacerating her mesentery and distal small intestine; and

  • failed to recognize that he had lacerated areas he did not intent to lacerate.

    She claims Anderson Hospital was negligent by failing to respond to her concerns following surgery, failing to recognize her complications following surgery and by discharging her without adequate investigation of her post-operative complaints.

    Diser claims that due to the alleged negligence she was caused to sustain severe and permanent disabling and disfiguring injuries to her abdomen, internal organs and body as a whole that caused and will continue to cause great pain and mental anguish, lost wages and medical expenses.

    Represented by Gregory Shevlin of Belleville, Diser is seeking damages in excess of $150,000, plus costs.

    The case has been assigned to Circuit Judge David Hylla.
