Roger W. Nagel filed a Federal Employers' Liability Act complaint against Burlington Northern & Santa Fe Railway Co. in St. Clair County Circuit Court July 3 claiming he was injured when a train hit a bump in the track.
Nagel, a brakeman, he fell and sustained severe and chronic injuries on Nov. 23, 2005, somewhere between Litchfield and Lowder, Ill.
He alleges the railroad failed to provide him a reasonably safe place to work and failed to inspect and discover an unsafe and defective condition of the railroad track on which plaintiff was instructed to work, among other things.
Nagel is represented by Dawn M. Mefford of Simon Passanante in St. Louis.
