Miss Kitty's, a Washington Park adult liquor and exhibition hall, is being sued for more than $100,000 by a patron who was beaten and robbed outside the club last year.
Anthony Cole of St. Clair County claims he temporarily left the club at 9 p.m. on Sept. 15, 2006, to return a phone call.
"While...returning aforesaid phone call, plaintiff was set upon and assailed and assaulted by three unknown persons who struck him about the head with a two-by-four wooden board, rendering him insensible and thereafter robbing him of his personal property and possessions," states the complaint filed June 27 in St. Clair County Circuit Court.
Cole claims he suffered a non-displaced jaw fracture, concussion, post-concussion syndrome, dislocation of his tempro-mandibular joint and facial lacerations and scarring.
"Plaintiff experiences clicking, pain and discomfort upon occlusion and plaintiff is no longer able to masticate without pain, suffering, muscle spasms and the like," the complaint states.
He also claims he suffers from loss of sleep, nausea, nervousness and irritability.
"Plaintiff's ability to carry out his normal work and occupation has been interfered with," the complaint states.
Cole claims he has lost $1,500 in earnings to date and will sustain additional loss of earnings in the future. His medical expenses to date total approximately $10,000, the suit claims.
"...[I]t was reasonably foreseeable that plaintiff, or persons similarly situated to plaintiff would be set up on criminally and defendant knew on the exercise of ordinary care should of (sic) known of such reasonably foreseeable likelihood, but took no reasonable or adequate steps to deter or impede or discourage such assaults," the complaint states.
