Carman claims he was pinned by crane

Railroad worker Charles Goode of Dupo is suing Union Pacific for injuries he sustained when a crane rolled backwards and pinned him between a rail car.

According to a complaint filed March 21 in St. Clair County Circuit Court, Goode was employed as a carman when the incident occurred Jan. 8 near Benton, Ill.

Seeking in excess of $150,000 in damages, Goode claims he suffered injuries to his hip, including but not limited to fractures of the pelvis from the medial surfaces of the pelvis into the central portion of the acetavulum. He also claims lower back and lower extremity injuries.

He claims medical expenses, lost wages, pain and suffering and loss of normal life.

Goode is represented by Mark Dupont of Dupo.

The suit claims a long list of alleged negligent acts on the part of Union Pacific, including:

  • Failure to have two cranes at the scene to lift the empty coal car on both ends at the same time;

  • Failure to follow normal policies and procedures for loading scrap coal cars onto flat bed rail cars;

  • Failure to replace crane when it was outdated and unsafe for use;

  • Failure to have proper backup signals on its crane as required by law;

  • Failure to properly have its crane with the design that would allow the crane to be in a locked position which would prevent it from moving while the crane operator was getting power to the outriggers; and

  • Failure to have a proper backup alarm to warn the operator and ground personnel that the unit was left in gear and may make a reverse movement.
