Auto glass worker claims retaliatory discharge

Brandon Johnson, a former employee at C&W Auto Glass in Godfrey filed a retaliatory discharge suit in Madison County Circuit Court June 13, alleging he was fired after receiving workers' compensation benefits.

Represented by Lance Mallon of Wood River, Johnson claims on June 9, 2005, he injured himself while on a work project for C&W. Johnson began his employment in June 2004.

According to the complaint, company owner Tim Gill fired Johnson on Feb. 28, because he exercised his rights under the Illinois Workers' Compensation Act in violation of Illinois law.

Johnson claims his discharge caused him to lose wages, benefits, raises and promotions, costs with securing new employment and caused mental distress and humiliation.

Johnson is seeking damages in excess of $50,000, costs of litigation and other relief the court deems just and proper.

The case has been assigned to Circuit Judge Lola Maddox.
