Dillard's shopper sues for tripping on clothing rack

Pamela Wilson filed a personal injury suit against Dillard's department store seeking damages in excess of $50,000 for injuries she allegedly sustained after tripping on a clothing rack on Feb. 5.

According to the complaint filed in St. Clair County Circuit Court April 3, Wilson was shopping at the St. Clair Square mall in Fairview Heights when Dillard's negligently caused and permitted the walkway of its store to become and remain in a dangerous condition.

Wilson claims Dillard's failed to manage, inspect and maintain the placement of clothing racks in a safe position, failed to have a safe procedure for positioning clothing racks, failed to inspect clothing racks to prevent potential protruding and failed to have anchors or any other means of securing the clothing rack to the floor to prevent it from sliding and causing injury.

She claims she suffered extensive injuries to her head, body and limbs, spent money for medical treatment, and experienced pain and suffering as a result of her injuries.

Wilson also is requesting an order for discovery to include all of Dillard's accident reports, unedited video tapes, security logs, security tapes and recordings, telephone logs tapes and recordings, and any other information regarding her accident.
