East St. Louis walker sues city for uneven sidewalk

Parthenia Spates of East St. Louis is suing the city and Denverside Apartments for knee, wrist and ankle injuries she sustained after tripping on a sidewalk.

Spates claims the city and the apartment complex are negligent for allowing a portion of the sidewalk to be raised approximately an inch and a half near 1644 Boismenue.

Seeking damages in excess of $100,000, Spates claims the defendants failed to maintain the sidewalk in a reasonably safe condition. She also claims the hazards were known, but the defendants failed to warn her of the danger.

Spates is represented by John H. Hustava of Collinsville.

The accident took place at approximately 6:20 a.m. on July 8, 2005, while Spates was taking her morning walk.

"The plaintiff has experienced pain and suffering and will be reasonably certain to experience pain and suffering in the future as a result of the injuries," the complaint states.
