Famous-Barr sued for escalator injury

Famous-Barr at St. Clair Square in Fairview Heights

Sarah Kincaid filed a personal injury law suit against Famous-Barr claiming she was violently jerked forward while descending a motionless escalator at the Fairview Heights store on Nov. 16, 2003.

According to the complaint filed Nov. 7 in St. Clair County Circuit Court, Famous-Barr allowed the escalator to operate in an unsafe and defective condition.

Kincaid claims she injured her left shoulder.

She also claims she suffered physical pain and mental anguish, became liable for medical expenses and has been prevented from attending to her usual duties and affairs.

Represented by Ronald Motil of Beatty, Motil and Foster of Glen Carbon, Kincaid is seeking at least $100,000 for the injuries she allegedly sustained.
