O'Fallon resident suing city for sewer back flow

Linda Todoroff is suing O’Fallon for raw sewage that backed into her basement at 610 West Adams St.

Citing breach of numerous legal standards, the complaint was filed Nov. 3 in St. Clair County Circuit Court.

Todoroff claims the city violated its own ordinances as well as statutes of the Illinois Environmental Protection Agency Act and the Litter Control Act “by dumping, depositing…raw sewage, a nauseous or offensive matter, upon plaintiff’s property.”

The suit also claims the city’s sewer lines were not adequately protected from excessive infiltration of ground water. Todoroff alleges her home was damaged between Dec. 3 and Dec. 24, 2004.

“Defendant knew and knows that upon periods of heavy rainfall, a substantial amount of ground water infiltrates into the sewer system, overloads the sewer system and causes sewer backups,” the complaint states.

“The sewer back ups cause raw sewage to backflow through the sewer system into resident’s homes.”

Todoroff is seeking in excess of $150,000 in damages that also include “temporary nuisance” and trespassing.

She is represented by Hrant Norsigian Jr. of the Castle Law Office of St. Louis.
